REPRESENTATIVE LITIGATION

  • BURNS can be the most horrendous non-fatal injury. Talpos & Arnold, P.C. had the honor of being selected to represent a middle aged woman who was severely injured when her sweater burst into flames from lit tobacco which dropped from her cigarette. She suffered 2nd and 3rd degree burns on her stomach, breasts, and neck. Extensive discovery was necessary to determine the manufacturer of the sweater, the hazardous manner in which the fabric had been knitted to create the sweater, and the disregard by the retailer for the safety of its customers. The case mediated for one-half million dollars as a result of the labors of the firm.

  • CLOSED HEAD INJURIES effect you for life. John C. Talpos was lead counsel for a trial against a major municipality. As a result of the municipality's failure to maintain stop signs, the motorcyclist/client struck and catapulted over a taxi. The client sustained not only a closed head injury, but also fracture of the arm, ribs, pelvis and lower leg. Both sides rejected mediation and the firm was able to persuade the jury to return a verdict more than three times that amount. The total amount recovered by the client was just under one million dollars.

  • BUSINESS LITIGATION can be complex but rewarding. Talpos & Arnold, P.C. was privileged to represent two separate franchisees, one from Michigan and one from Illinois. These individuals had invested their life saving to pursue the sale of an after-market safety braking system for automobiles. Their investments were fraudulently induced by the franchiser. Interest and sanctions imposed upon the defendant brought the total jury award to in excess of four million dollars.

  • SUNDAY SCHOOL was the joy of a client's life. Teaching classes to preschoolers gave her great satisfaction. She cooked for her church shut-ins and church funerals. She enjoyed sewing, baking and making her house a home. However, this 63 year old energetic woman learned pain, anguish, and depression as a result of a landlord's failure to maintain its premises. The client fell as a result of that failure and sustained an excruciating right shoulder dislocation with severe brachioplexus palsy. She could not take care of her own personal hygiene, cut her food, tie her shoes or hang up her clothes. The defendant's capitulated and agreed to settle her case for a substantial amount in the six figures as the trial was about to start.
